General Terms and Conditions

1. Definitions

In these general terms and conditions, the following is understood to mean:

Hophelden.nl: the company Trendybox, established in Pernis Rotterdam, trading under Chamber of Commerce number 97485225
Customer: any natural person aged 18 or older or legal entity that enters into an agreement with Hophelden.nl.
Agreement: any purchase agreement concluded via hophelden.nl.
Products: specialty beer and other related items offered via hophelden.nl.
Breweries: independent micro- and craft breweries whose products are sold by Hophelden.nl.

3. Applicability

These general terms and conditions apply to every offer, every order, and every agreement concluded via hophelden.nl.
The terms and conditions are made available to the customer prior to the conclusion of the agreement.
Deviation from these terms and conditions is only possible if agreed in writing.
If one or more provisions prove to be invalid, the remaining provisions shall remain in full force and effect.

4. Age limit (18+)

Hophelden.nl sells alcohol exclusively to customers aged 18 or older.
By placing an order, the customer declares that he/she is 18 years of age or older.
Age verification can take place during the ordering process and is mandatory upon delivery.
If age cannot be established upon delivery, the order will not be issued; costs may be charged to the customer.

5. The offer

The offer contains a complete and accurate description of the products offered.
Prices include the legally required VAT and exclude shipping costs, unless otherwise stated.
Product photos and descriptions are for illustrative purposes only; variations in color, taste, and batch may occur with artisanal products.
Hophelden.nl reserves the right to modify the offer or make corrections.
Products are available while stocks last; some beers are seasonal or batch-specific.

6. The agreement

The agreement is concluded at the moment the customer places an order and Hophelden.nl confirms it by email.
Hophelden.nl reserves the right to refuse orders, including in the event of suspected misuse, stock problems, or incorrect data.
Placed orders can only be modified if the order has not yet been processed.

7. Prices and payment

All prices are quoted in euros and include VAT.
Shipping costs are listed and calculated separately.
Payment must be made in full via one of the offered payment methods, as stated on the website.
The order will only be shipped after full payment by the customer.
Obvious pricing errors do not bind Hophelden.nl; in that case, the customer is informed and may cancel the order free of charge.

8. Delivery

Delivery takes place at the address provided by the customer.
The expected delivery time is approximately 3 working days, unless otherwise stated and excluding holidays.
Shipping costs are calculated based on quantity and number of packages, unless otherwise agreed.
The risk of damage or loss rests with Hophelden.nl until the moment of delivery.
Damage, loss, or incorrect delivery must be reported within 2 days of receipt, including photos and the order number.

9. Right of withdrawal

You have the right to cancel your order within fourteen days of receipt, without giving any reason. This period begins on the day that you, or someone you have designated, receives the last product from the order.
You revoke via the form on hophelden.nl/bestelling-herroepen, or by an unambiguous statement via email to info@hophelden.nl. You will always receive a confirmation of this.
After your notification, you have fourteen days to return the products. Return them unopened and undamaged, in the original packaging. If products are opened or damaged, we may deduct the resulting reduction in value from the amount to be refunded.
The costs of the return shipment are at your expense. If a product arrives damaged or is delivered incorrectly, we will cover those costs.
We will refund within fourteen days of receiving your report, using the same payment method you used. We may wait to do so until we have received the products back, or until you have proven that you have sent them.
If you cancel the entire order, we will also refund the shipping costs for the outbound shipment, based on the cheapest standard delivery. If you return part of the order, the shipping costs remain.
The right of withdrawal does not apply to products that we have made or put together especially for you at your express request, such as a custom-made beer package or a bottle with a personalized label. Our standard packages and promotional packages are not included; you can simply return those.

10. Warranty and conformity

Hophelden.nl guarantees that products comply with the agreement and legal requirements.
Craft beers can vary in taste, aroma, and appearance; such batch differences do not constitute grounds for a guarantee.
Complaints regarding quality defects must be reported immediately upon discovery and will be assessed individually.

11. Complaints procedure

Complaints must be submitted in writing within 5 days via info@hophelden.nl.
Hophelden.nl aims to respond substantively within 2 working days.
If the complaint cannot be resolved through mutual agreement, the customer may turn to a disputes committee.

12. Force Majeure

In the event of force majeure, Hophelden.nl is not obliged to fulfill its obligations.
Force majeure includes, but is not limited to: logistical disruptions, pandemics, production shortages at breweries, breakdowns, fire, war, government measures, and other circumstances beyond the control of Hophelden.nl.

13. Liability

Hophelden.nl is not liable for indirect damages such as consequential damages, loss of profit, or intangible damages.
Liability remains limited to the amount of the order to which the damage relates.
Nothing in these terms and conditions excludes liability for intent or gross negligence.

14. Privacy

Hophelden.nl processes personal data in accordance with the General Data Protection Regulation (GDPR).

15. Intellectual property

All texts, photos, logos, names, and other content on hophelden.nl remain the property of Hophelden.nl or the suppliers/breweries and may not be used or copied without prior written permission.

16. Applicable law

These general terms and conditions are governed exclusively by Dutch law.
